These Terms of Service (“Terms”) govern your access to and use of the sleepSEE website at sleepsee.com (the “Site”) and any related services offered by sleepSEE (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Description of Services

sleepSEE is a consumer brand specializing in orthokeratology (ortho-k) vision correction. Through the Site, we provide:

• Educational information about orthokeratology and myopia control
• A candidacy screening quiz to help users assess their suitability for ortho-k
• A provider directory to connect users with certified sleepSEE eye care professionals
• A provider network for qualified optometrists and ophthalmologists
• Blog content, newsletters, and downloadable educational resources

sleepSEE does not provide medical advice, diagnose conditions, or prescribe treatments. All clinical decisions are made by your individual eye care provider.

2. Eligibility

You must be at least 18 years old to use the Site independently. Parents or legal guardians may use the Site on behalf of minors. By using the Site, you represent that you meet these eligibility requirements.

3. User Accounts

Certain features of the Site (such as the provider portal) may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or inaccurate information
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the Site’s infrastructure, security, or other users’ access

• Use the Site to transmit spam, malware, or other harmful content

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, videos, the sleepSEE brand name, and software — is the property of sleepSEE or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the Site without our prior written consent, except for personal, non-commercial use such as printing a page for your own reference.

6. Provider Network

sleepSEE maintains a network of independent eye care professionals (“Providers”). These Providers are independent practitioners, not employees or agents of sleepSEE. We do not:

• Control or direct the clinical judgment of any Provider
• Guarantee the availability, quality, or outcomes of any Provider’s services
• Assume liability for any acts or omissions of any Provider

Your relationship with any Provider you contact through the Site is between you and that Provider. sleepSEE facilitates the connection but is not a party to any patient-provider relationship.

7. Candidacy Quiz Disclaimer

The sleepSEE candidacy quiz is a preliminary screening tool designed to provide a general indication of whether ortho-k may be suitable for you. The quiz results are not a medical diagnosis, prescription, or guarantee of treatment outcomes. Only a qualified eye care professional can determine your actual candidacy for orthokeratology after a comprehensive eye examination.

8. Satisfaction Guarantee

sleepSEE offers a 30-day satisfaction guarantee on ortho-k treatment initiated through our certified provider network, subject to the following conditions:

• The guarantee applies to the sleepSEE program fee only, not to individual provider examination or fitting fees
• You must follow all prescribed wearing schedules and care instructions
• You must attend all scheduled follow-up appointments
• The guarantee period begins on the date you receive your custom lenses

Specific terms of the satisfaction guarantee may vary by provider. Please confirm the details with your individual Provider before beginning treatment.

9. Limitation of Liability

To the fullest extent permitted by law, sleepSEE and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or services, including but not limited to:

• Any errors or omissions in Site content
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of the Site
• Any clinical outcomes resulting from treatment by a Provider

Our total liability for any claim arising from your use of the Site shall not exceed the amount you paid to sleepSEE, if any, in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless sleepSEE and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Disclaimers

The Site and all content are provided “as is” and “as available” without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are seeking injunctive or equitable relief.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms.

14. Severability
